TERMS AND CONDITIONS

To qualify for wholesale status, you must be actively involved in the wholesale or retail redistribution of plants: landscaping or building contractors, property management, nurseries, garden centers, schools, towns, and/or municipalities. Please do not send your clients/customers to us unaccompanied by you, the wholesaler. We do not quote wholesale prices, offer design, or other assistance to your retail customers without your physical presence.

Payment terms are C.O.D. unless credit has been approved in advance. First time customers will pay at the time of purchase. Credit terms, when established, are NET 30 DAYS from date of purchase, not 30 days from date of statements that are sent out each month. A service charge of 1 ½% per month, (18% per annum), will be added to all overdue accounts. In any case, when accounts exceed 60 days, credit will be terminated and future sales will be handled on a cash only basis. Wilde Oaks Nursery, Inc. reserves the right to cancel credit at any time. Customers will be responsible for all attorney fees, collection cost, and court cost incurred should collection of debts become necessary.

ORDERS

To ensure the quality and best performance of plants, all orders need to be picked up no later than two (2) weeks past scheduled pickup date. Otherwise, the plants will be returned to inventory.

CLAIMS

All orders are subject to crop and labor conditions. We reserve the right to cancel the entire, or part of an order, if stock is injured due to insects, disease, weather or any other natural cause that is beyond our control. All scheduled orders will be processed as close as possible to the specified time agreed on, but we cannot be liable for delays due to problems caused by factors beyond our control. We cannot entertain any claims that are not made within five (5) days of receipt of stock.

GUARANTEE

All stock sold is guaranteed to be healthy and true to name and color. If any stock can be proven untrue to description or name, we will replace it without charge or refund the original purchase price. In no case shall we be liable for any sum in excess of the original purchase price of the stock in question. In no event shall the seller (Wilde Oaks Nursery) be liable to the buyer (customer) for any business or commercial loss, including but not limited to, lost profits.

LIABILITY

Liability for purchased plants ceases for the seller (Wilde Oaks Nursery) upon delivery to the buyer’s possession or common carrier. Due to conditions beyond our control, we offer no guarantee, expressed or implied, on the livability of our plants after leaving our nursery and will not be responsible for the results secured in transplanting.

ALL TRANSACTIONS ARE BOOKED WITH THE EXPRESS UNDERSTANDING THAT THE CUSTOMER HAS READ, UNDERSTOOD AND AGREES TO THE TERMS AND CONDITIONS STATED ABOVE IN FULL.
